These Terms of Service ("Terms") govern your use of the Topbento website and your dealings with Topbento ("we", "us", the "Company"), a catering business located at 296 Barber Ct, Milpitas, CA 95035. By using this website you agree to these Terms. If you do not agree, please do not use the website.
About Our Service
This website presents information about our Chinese catering service, including bento boxes and full-size catering trays, and the categories of dishes we cook. The website is informational: it does not take orders and does not process payments.
Orders are arranged directly with us by phone or email. An order is only confirmed once we have confirmed it with you directly. Bento orders start at 15 boxes.
Menu, Availability and Pricing
Dish listings show what we cook, not a guarantee that every dish is available on every date. Availability depends on the season, the size of your order and our kitchen schedule. Pricing is not published on this website; we quote based on the dishes selected and the details of your event, and a quote is valid only as stated when we give it.
Food, Allergens and Dietary Requirements
Our dishes are prepared in a kitchen that handles common allergens, including shellfish, fish, soy, wheat, peanuts, tree nuts, eggs and sesame. We cannot guarantee that any dish is free from a particular allergen or from cross-contact. If anyone in your group has a food allergy or dietary requirement, you must tell us before placing an order so we can advise whether we can accommodate it. You are responsible for informing your guests about the food served.
Use of This Website
You agree not to use this website to break the law, to interfere with its operation or security, to submit false or misleading information through our enquiry form, or to send unsolicited commercial messages. You agree not to attempt to gain unauthorised access to any part of the site or its systems.

The text, photographs, layout and design of this website belong to Topbento or are used with permission, and are protected by copyright and other laws. Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, this website, or our services that cannot be resolved informally shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court. The arbitration shall take place in the county and state in which the Company's principal place of business is located, unless applicable law requires otherwise.
Class Action & Jury Trial Waiver
You and the Company agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. You and the Company waive any right to a jury trial and any right to participate in a class action or class-wide arbitration.
If any portion of this section is held unenforceable, the remainder of this section shall remain in effect; however, the prohibition on class, collective, or representative proceedings is non-severable.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules, except that the arbitration provision above is governed by the Federal Arbitration Act.
